Moving from Poland (EU Temporary Protection) to Spain (Alicante / Valencia) — Practical 2026 Guide
Who this is for: A Ukrainian citizen currently in Poland with PESEL UKR (EU Temporary Protection / ochrona czasowa), holding a biometric Ukrainian passport, who wants to live, work and access healthcare legally in the Comunidad Valenciana (Alicante / Valencia).
⚠️ This is research to inform decisions — NOT legal advice. Immigration rules for Ukrainians changed repeatedly in 2025–2026 and vary by province and even by individual extranjería office. Confirm every step with an official cita previa, the CREADE centre, or an abogado/a de extranjería before acting. Facts below are date-stamped as of 23 July 2026.
1. Can you hold Temporary Protection in two EU countries at once? (Poland → Spain)
Short answer: No. You can benefit from Temporary Protection (TP) in only one EU Member State at a time. This is the core "one country – one protection" rule.
- The European Commission states plainly: "you can benefit from temporary protection only in one EU Member State at a time." When you move, "the residence permit in the first EU country will expire and your rights there will come to an end," and the new country registers you and issues a new residence permit. - Practically this means: Spain issues a fresh TP grant (new NIE + residence card). Your Polish protection does not transfer — it ends.
What happens to your Polish PESEL UKR:
- PESEL UKR / TP in Poland is currently legal until 4 March 2027. (UNHCR Poland)
- Leaving Poland for more than 30 days automatically ends PESEL UKR status under the Polish special law, regardless of the reason for travel. So a permanent move to Spain will, by itself, terminate your Polish TP after ~30 days. (UNHCR Poland – legal changes from 4 March 2026; reported by Visit Ukraine)
Anti-double-registration / coordination:
- Member States share TP registration data to prevent one person drawing benefits (housing allowance, social payments) in two countries at once. You should inform the Polish authorities before leaving and not attempt to keep both statuses live. (EU Commission – your rights)
- Best practice: treat this as a clean hand-off — stop claiming Polish benefits (e.g. 800+), keep proof of your Polish registration/end date, and register in Spain. Trying to hold both is the main compliance risk.
Current TP validity across the EU (date-stamped):

- NEW (26 June 2026): the Commission has proposed extending TP a further year to 4 March 2028 — still pending Council approval as of July 2026. - ⚠️ Uncertain how this affects you: you are an existing TP beneficiary moving within the EU, not a person newly arriving from Ukraine. Intra-EU movers have historically still been registered by the receiving state, but if/when the 2028 rules take effect the receiving office's discretion may tighten. Verify with the CREADE/abogado before you travel.
2. How to register for Protección Temporal in Spain — step by step
Spain's TP procedure for people displaced from Ukraine is run by the Ministerio de Inclusión, Seguridad Social y Migraciones via the CREADE centres and the Policía Nacional (extranjería). (inclusión.gob.es – Trámites)
Steps:
- Get a cita previa (appointment) at a CREADE centre or a police extranjería office.
- Attend in person with your documents (below).
- File the application (solicitud de protección temporal).
- Receive your NIE + expediente number on the spot / very quickly.
- Download your Temporary Protection certificate (resguardo/resolución) online using NIE + expediente number + date of birth.
- Book a TIE appointment at sede.administracionespublicas.gob.es/icpplus.
- Collect your TIE card (fingerprints taken, card issued).

The official healthcare page confirms there are four CREADE reception centres — Madrid, Barcelona, Alicante and Málaga — which also give an initial medical check on arrival. For an Alicante/Valencia move, the Torrevieja (Alicante) CREADE or the local Policía Nacional extranjería office (Alicante/Valencia) is the natural entry point. - Biometric Ukrainian passport (or ID/travel document).
- Proof of family ties if applying with family (marriage certificate, children's birth certificates).
- Photos (carné size) for the TIE.
- Bring, if you have it, proof of your prior Polish registration and its end/deregistration — helpful to show the office you are transferring, not double-registering (not a formally listed requirement, but reduces friction).
Resulting document & timing:

- ⚠️ In practice the physical TIE card takes longer (typically a few weeks between fingerprinting and card pickup) and depends on office backlog. Treat "24 hours" as the status grant, not the plastic card.
- Once granted, TP in Spain is valid for the whole duration of the EU regime and is auto-extended to 4 March 2027 without re-applying, under EU Decision 2025/1460 implemented in Spain by Orden INT/96/2026 — even if your TIE shows an earlier printed expiry date, it remains legally valid. 3. NIE vs TIE for TP beneficiaries
- NIE (Número de Identidad de Extranjero): your unique foreigner identification number. Assigned when you file the TP application. It is a number, not a card — used for contracts, work, banking, tax.
- TIE (Tarjeta de Identidad de Extranjero): the physical residence card that carries your NIE, photo and fingerprints and proves your legal residence + work authorisation under TP. Booked separately at icpplus after the grant.

4. Empadronamiento (padrón municipal)
What it is: registration in your town/city's municipal population register (the padrón). It records that you live at a given address in that municipality.
Why it's essential: it is the gateway to public healthcare (tarjeta sanitaria/SIP), school places, and proof of residence for many procedures. In the Comunidad Valenciana the health card is normally issued for people registered (empadronados) at an address in the region. (Ayto. Valencia – Padrón; Generalitat Valenciana – Tarjeta Sanitaria)
How to do it (Comunidad Valenciana):
- Book a cita at your town hall (ayuntamiento) / Oficina de Padrón (often online via the municipal sede electrónica).
- Bring: passport (and, once you have it, TIE/NIE), the completed hoja padronal, and proof of address.
- Proof of address options:
- A rental contract in your name (generally needs to be current, minimum ~6 months' duration); or
- If you live in someone else's home: a signed authorisation from the property owner / main tenant plus a copy of their DNI/NIE. (Ayto. Valencia – Padrón)
If you have no formal contract / owner won't sign: empadronamiento is a right for everyone actually living in the municipality, regardless of immigration status. Municipalities can register you via social services or as sin domicilio fijo / "empadronamiento en infravivienda"; a padrón does not grant any property or tenancy right, which is why owners can sign safely. 5. Healthcare — tarjeta sanitaria / SIP in the Comunidad Valenciana
Your entitlement: Ukrainians with TP have the right to free public healthcare through the Sistema Nacional de Salud (SNS), provided "de forma universal y gratuita." (inclusión.gob.es – Atención sanitaria)

How to get it:
- Get empadronado at your address (Section 4).
- Go to your assigned centro de salud (primary care centre) for your address with passport/TIE-NIE, padrón certificate, and your TP resolución.

Timeline & the gap before it's active:

6. Work rights — can you work immediately?
Yes. Spanish Temporary Protection grants residence + work authorisation for the full duration of protection, with no separate work permit needed. (inclusión.gob.es – ¿Qué es la Protección Temporal?)
- Employed (por cuenta ajena): you may work for any employer, any sector. HR can onboard you and run first payroll once the NIE is active — no need to wait for the plastic TIE. (Jobbatical employer guide)

- You will also need a social security number (NUSS) to be hired or registered as autónomo — obtainable via the Tesorería General de la Seguridad Social with your NIE.
7. Realistic timeline: arrival → TIE + padrón + tarjeta sanitaria
Assumes a Ukrainian passport holder entering visa-free and starting the process promptly. Times vary by office backlog — treat as a realistic range, not a guarantee.

Rough total to have all three (TIE + padrón + SIP) in hand: ~1 to 2.5 months, mostly gated by appointment availability, not by the legal process itself. Work can start earlier (as soon as NIE + NUSS are active).
Uncertain / verify before acting
- 2028 extension & "newly arriving" restriction. TP is firm to 4 March 2027; the further extension to 4 March 2028 is only a Commission proposal (26 Jun 2026), not yet adopted. How its stricter "not authorised to leave Ukraine" language applies to someone already in the EU moving Poland→Spain is not clearly settled — confirm at the CREADE/abogado before you travel.
- Whether Spain re-grants fresh TP to an existing Polish beneficiary. The one-country rule means Poland ends and Spain starts a new grant; intra-EU movers have generally been registered, but individual offices retain discretion. Get this confirmed for your case.
- Poland's ">30 days absence = automatic loss of PESEL UKR" rule is well-reported (UNHCR Poland + Polish special law) but the exact mechanics/timing are best re-checked with UNHCR Poland (800 012 948) before you leave.
- CREADE Alicante (Torrevieja) phone/hours and whether it takes first-time TP filings vs. only medical intake — call to confirm it can process your application, or use Policía Nacional extranjería in Alicante/Valencia.
- Padrón document requirements differ by municipality (Alicante vs Valencia vs Torrevieja) — check your specific ayuntamiento.
- The "within 24 hours" grant is the status resolution, not the physical TIE; card issuance takes weeks.
